We reserve the right to decline projects or partnerships at our discretion.

5. Intellectual Property
All creative concepts, campaign ideas, copy, graphics, and strategy materials produced by Hudson Menary Media remain our intellectual property until full payment is received or otherwise stated in writing.
Upon full payment, ownership of deliverables is transferred to the client, excluding any stock assets, templates, or third-party licensed materials that remain subject to their respective licences.

You may not reuse, modify, or distribute our materials or website content without written permission.

6. Client Responsibilities
Clients are responsible for:

  • Providing accurate, complete, and timely information for campaigns and creative production.
  • Ensuring they have the rights to use any materials supplied (e.g., logos, images, or copy).
  • Approving deliverables within agreed timelines to avoid project delays.

Hudson Menary Media will not be liable for errors, delays, or campaign outcomes arising from incorrect or incomplete client information.

7. Payments and Invoices
Invoices are due within the payment terms stated on the invoice (typically 14 days). Late payments may result in paused campaigns or additional administrative fees.
For ongoing retainers or media spend accounts, payment may be required in advance or as otherwise specified in the agreement.

8. Media Buying and Third-Party Platforms
We buy media space across various platforms such as Google Ads, Meta, TikTok, Spotify, oOh!media, and others on behalf of clients.
While we take all reasonable steps to optimise performance, we do not guarantee specific outcomes (e.g., reach, engagement, conversions) as these are influenced by third-party algorithms and market conditions.

Clients acknowledge that once ads are placed or budgets are spent, refunds cannot be issued unless required by law.

9. Limitation of Liability
Hudson Menary Media is not liable for any loss, damage, or expense resulting from:

  • Website downtime, errors, or interruptions
  • Delays in project delivery due to client delays or external platforms
  • Indirect, consequential, or incidental damages related to campaign performance or business outcomes

To the fullest extent permitted by law, our total liability for any claim is limited to the amount paid by the client for the specific service in question.

10. Privacy and Data
Any personal or business information collected through our website or forms is handled in accordance with our Privacy Policy.
By submitting your details via the contact form, you consent to us using your information to respond to your enquiry and send occasional updates or offers (you can opt out at any time).

11. Termination
Either party may terminate an engagement with reasonable written notice. If the client terminates early, payment for all work completed and any committed third-party costs (e.g., booked media) will still be required.

12. Changes to Terms
We may update these Terms of Service from time to time. The revised version will be posted on our website with the new effective date. Continued use of our site or services after changes are posted constitutes acceptance of the updated terms.

13. Governing Law
These Terms are governed by the laws of Queensland, Australia. Any disputes shall be handled in the courts of Queensland.
